Lone Star Company, a liquor wholesaler, sued European Import Company, a retailer, to recover $98,621.99 for alcoholic beverages delivered to European’s stores. European filed a sworn denial, contending it had not ordered the merchandise. At trial, the jury made several key findings: (1) European did not order the goods; (2) Lone Star delivered the goods to European; and (3) European accepted the goods. Evidence of acceptance included numerous invoices bearing European’s acceptance stamp, the actions of an employee with apparent authority to manage the business, and a check tendered by European’s president to pay for the merchandise. Despite the finding that the goods were not ordered, the trial court entered judgment for Lone Star based on the jury’s findings of delivery and acceptance. European appealed, arguing that without an order, no sale could have been consummated.
