Plaintiffs Tarik Farag, a U.S. citizen and federal corrections officer, and Amro Elmasry, an Egyptian citizen, both of Arab descent, were observed by two undercover counterterrorism agents on a domestic flight. The agents found their behavior suspicious, citing their speaking in a mix of Arabic and English, changing seats to be closer, Elmasry looking at his watch, moving to the back of the plane without carry-on luggage, and Elmasry deleting contacts from his phone. Believing the plaintiffs might be conducting terrorist surveillance, the agents arranged for a police response upon landing. At JFK airport, at least ten officers in SWAT gear with police dogs met the plaintiffs. They were separated, frisked, handcuffed, transported to a Port Authority police station, and placed in separate jail cells. They were interrogated for several hours about their actions, religious beliefs, and potential terrorist connections before being released approximately four and a half hours later without any charges.
