Respondents, the Merrill brothers, applied for crop insurance from the Federal Crop Insurance Corporation (FCIC), a wholly government-owned agency. They informed the FCIC’s local agent that 400 of their 460 acres of spring wheat were reseeded on winter wheat acreage. The agent advised them that the entire crop was insurable. Relying on this advice, the Merrills obtained insurance. The formal application did not disclose that part of the crop was reseeded. After a drought destroyed most of the crop, the FCIC refused to pay for the loss on the reseeded acreage. The denial was based on a specific Wheat Crop Insurance Regulation, which had been duly promulgated and published in the Federal Register, explicitly stating that spring wheat reseeded on winter wheat acreage was ineligible for insurance. The Merrills had no actual knowledge of this regulation and argued that the FCIC was bound by its agent’s representations, just as a private insurer would be.
