Case Brief Summary & Legal Analysis
tl;dr: A private attorney hired by a city for an internal investigation was sued under § 1983. The Supreme Court held that private individuals temporarily working for the government can claim qualified immunity, just like permanent public employees, because immunity attaches to the governmental function, not employment status.
Legal Significance: This case establishes that qualified immunity under § 1983 extends to private individuals retained by the government to perform public functions. The analysis focuses on the nature of the work performed for the government, not the actor’s formal employment relationship with the state.

Case Facts & Court Holding
Key Facts & Case Background
The City of Rialto, California, suspected that one of its firefighters, Nicholas Delia, was feigning illness to miss work. The City hired Steve Filarsky, a private attorney specializing in employment investigations, to conduct an internal affairs inquiry. During the investigation, Filarsky, along with city fire officials, questioned Delia about building supplies he had purchased. When Delia refused to consent to a search of his home to view the materials, Filarsky advised the Fire Chief to order Delia to bring the materials out of his house for inspection. Delia complied under threat of insubordination. Delia subsequently filed a lawsuit under 42 U.S.C. § 1983 against the City, its officials, and Filarsky, alleging the order constituted an unconstitutional search in violation of the Fourth Amendment. The District Court granted qualified immunity to all individual defendants. The Ninth Circuit Court of Appeals affirmed immunity for the city employees but denied it for Filarsky, holding that as a private contractor rather than a public employee, he was not entitled to seek its protection.
