Case Brief Summary & Legal Analysis

General Brief

tl;dr: A testatrix’s will disinheriting her son and granddaughter was invalidated. The court affirmed a jury’s finding of incapacity based on evidence of her mental decline and the will’s “unnatural” disposition, which revoked a prior, more equitable will.

Legal Significance: Establishes that an “unnatural disposition” of property in a will, especially when revoking a prior, more equitable instrument, is strong circumstantial evidence that a jury can use, along with other factors, to find a lack of testamentary capacity.

Case Facts & Court Holding

Key Facts & Case Background

Ada B. Padgett (the “testatrix”) executed a will in April 1970, leaving her entire estate to her daughter, Mary Fletcher (the “proponent”). This will revoked a 1959 will that had provided for an equal distribution of her estate among her three children. After the testatrix’s death, her son and granddaughter (the “contestants”) challenged the 1970 will, arguing the testatrix lacked testamentary capacity. At trial, the contestants presented evidence that the testatrix had become depressed and disoriented following the death of another son in January 1970. Witnesses testified to a noticeable decline in her personal appearance and hygiene around the time the will was executed. The contestants also highlighted that the 1970 will completely disinherited them, constituting an “unnatural disposition” of property, and that there was no significant disparity in the financial conditions of the heirs that would justify such a change. The jury found the testatrix lacked testamentary capacity, and the trial court denied the proponent’s motion for a new trial.
