Joe Elton Nixon was charged with first-degree murder, kidnaping, robbery, and arson. Overwhelming evidence, including Nixon’s detailed confession, pointed to his guilt. His appointed counsel, Michael Corin, concluded that Nixon’s guilt was not reasonably disputable and that the best strategy to avoid the death penalty was to concede guilt during the trial’s guilt phase and focus on presenting mitigating evidence during the penalty phase. Corin attempted to discuss this strategy with Nixon multiple times, but Nixon was unresponsive and uncooperative, neither approving nor protesting. Corin proceeded with the concession strategy. Nixon was found guilty and sentenced to death. The Florida Supreme Court held that counsel’s concession of guilt without Nixon’s affirmative, explicit consent automatically constituted ineffective assistance, presuming prejudice under United States v. Cronic. The trial court had commended Corin’s strategy as an “excellent analysis of [the] reality of his case,” noting that denying guilt would have deprived counsel of credibility during the penalty phase.
