Case Brief Summary & Legal Analysis
tl;dr: Co-owners who recorded a judgment granting them the “whole interest” in a property and possessed it exclusively for over 30 years were found to have acquired full title by adverse possession, as the recording provided sufficient notice of their hostile claim to the other co-owners.
Legal Significance: This case establishes that for acquisitive prescription between co-owners, a recorded instrument, such as an ex parte judgment of possession, can serve as the required “overt and unambiguous act” giving notice of hostile possession, even without actual, personal notice to the other co-owners.

Case Facts & Court Holding
Key Facts & Case Background
The property in dispute was originally acquired by brothers C.C. Colvin and John A. Colvin as co-owners in 1874. The heirs of C.C. Colvin (Group A) and their ancestor continuously and exclusively possessed the property from at least 1900, performing acts of ownership such as farming, selling timber, and marking boundaries. The heirs of John A. Colvin (Group B) never exercised possession. In 1937, a judgment of possession was recorded in the Succession of C.C. Colvin, which recognized his heirs as owners of the “whole interest in and to” the property. Around the same time, most of John A. Colvin’s other heirs executed and recorded quitclaim deeds in favor of Group A, which recited that John A. had previously sold his interest to C.C. but the deed was lost. Group B, two of John A. Colvin’s heirs, did not sign the quitclaims. They argued that they only received actual notice of the adverse claim in a 1950 conversation, less than 30 years before the present concursus proceeding was filed to determine ownership of mineral royalties.
Court Holding & Legal Precedent
Issue: Can a co-owner’s recording of an ex parte judgment of possession purporting to grant them the ‘whole interest’ in a property constitute an overt and unambiguous act sufficient to provide notice of adverse possession to other co-owners, thereby commencing the 30-year period for acquisitive prescription?
Yes. The court affirmed the trial court’s judgment, holding that the C.C. Lorem ipsum dolor sit amet, consectetur adipiscing elit, sed do eiusmod tempor incididunt ut labore et dolore magna aliqua.
