The property in dispute was originally acquired by brothers C.C. Colvin and John A. Colvin as co-owners in 1874. The heirs of C.C. Colvin (Group A) and their ancestor continuously and exclusively possessed the property from at least 1900, performing acts of ownership such as farming, selling timber, and marking boundaries. The heirs of John A. Colvin (Group B) never exercised possession. In 1937, a judgment of possession was recorded in the Succession of C.C. Colvin, which recognized his heirs as owners of the “whole interest in and to” the property. Around the same time, most of John A. Colvin’s other heirs executed and recorded quitclaim deeds in favor of Group A, which recited that John A. had previously sold his interest to C.C. but the deed was lost. Group B, two of John A. Colvin’s heirs, did not sign the quitclaims. They argued that they only received actual notice of the adverse claim in a 1950 conversation, less than 30 years before the present concursus proceeding was filed to determine ownership of mineral royalties.
