The City of Kingman adopted a General Plan in 1992, which indicated that Kiersten Fritz’s property could support densities from one to four dwelling units per acre. At the time, Fritz’s land was zoned R-R, allowing only one dwelling per acre. In 1997, at Fritz’s request, the city adopted a zoning ordinance changing her land’s classification to R-1-8, permitting up to four dwellings per acre. A citizens group, the Committee for Responsible Zoning, successfully petitioned for a referendum to submit the rezoning ordinance to the electorate. Fritz sued to compel the city to reject the referendum petitions, contending that the rezoning ordinance was an administrative act merely implementing the pre-existing policies of the General Plan and therefore not subject to referendum. The trial court denied Fritz’s motion for summary judgment and granted the Committee’s countermotion, holding the rezoning was a legislative act. Fritz appealed.
