Case Facts & Court Holding

Key Facts & Case Background

The Environmental Protection Agency (EPA) issued a “PCB Risk Assessment Review Guidance Document” under the Toxic Substances Control Act (TSCA). This Document pertained to regulations allowing parties to apply for alternative methods for PCB cleanup and disposal, provided the proposed method did “not pose an unreasonable risk of injury to health or the environment.” The Guidance Document specified two approaches for risk assessment: (1) calculating cancer and non-cancer risks separately, requiring use of EPA-recognized cancer potency factors and accounting for specified non-cancer risks; or (2) using a “total toxicity factor” of 4.0 (mg/kg/day)-1, which the EPA indicated it would accept without further justification. General Electric Co. (GE) petitioned for review, arguing the Guidance Document was a legislative rule issued without the notice-and-comment procedures required by the TSCA and the Administrative Procedure Act (APA). The EPA contended the case was not ripe, the court lacked jurisdiction because the Document was not a “rule” under TSCA, and that it was not a legislative rule.
