Case Brief Summary & Legal Analysis

General Brief

tl;dr: An insurer denied coverage for a child’s lead poisoning injuries, citing a “pollution exclusion” in the landlord’s policy. The court held that lead-based paint is unambiguously a “pollutant” under the policy’s plain language, so the exclusion applies and the insurer has no duty to defend.

Legal Significance: Affirms Georgia’s strict textualist approach to interpreting “absolute pollution exclusions” in insurance contracts. The exclusion’s application is determined by the policy’s plain language, not the historical purpose of environmental pollution control, thus broadening its scope to include non-industrial, residential contaminants.

Case Facts & Court Holding

Key Facts & Case Background

A tenant, Amy Smith, sued her landlord, Bobby Chupp, alleging her daughter sustained injuries from ingesting lead from deteriorating lead-based paint in their rented home. Chupp was insured under a Commercial General Liability (CGL) policy issued by Georgia Farm Bureau Mutual Insurance Company (GFB). Chupp tendered the claim to GFB, which then filed a declaratory judgment action, arguing it had no duty to defend or indemnify him. GFB contended the policy’s “absolute pollution exclusion” clause barred coverage. The policy excluded “bodily injury… arising out of the actual, alleged or threatened discharge, dispersal, seepage, migration, release or escape of ‘pollutants’.” A “pollutant” was defined as “any solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids, alkalis, chemicals and waste.” The trial court granted summary judgment to GFB, finding lead-based paint was unambiguously a pollutant. The Court of Appeals reversed, holding the term was ambiguous in the context of residential lead paint and should be construed against the insurer. The Supreme Court of Georgia granted certiorari.
