Chupp was insured under a Commercial General Liability (CGL) policy issued by Georgia Farm Bureau Mutual Insurance Company (GFB). Chupp tendered the claim to GFB, which then filed a declaratory judgment action, arguing it had no duty to defend or indemnify him. GFB contended the policy’s “absolute pollution exclusion” clause barred coverage. The policy excluded “bodily injury… arising out of the actual, alleged or threatened discharge, dispersal, seepage, migration, release or escape of ‘pollutants’.” A “pollutant” was defined as “any solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids, alkalis, chemicals and waste.” The trial court granted summary judgment to GFB, finding lead-based paint was unambiguously a pollutant. The Court of Appeals reversed, holding the term was ambiguous in the context of residential lead paint and should be construed against the insurer. The Supreme Court of Georgia granted certiorari.
