Case Brief Summary & Legal Analysis

tl;dr: A law professor sued a colleague for battery over a shoulder touch in a hallway. The court found the contact was neither harmful nor offensive to a reasonable person and dismissed the case, deeming the plaintiff “unduly sensitive.”

Legal Significance: This case illustrates the objective “reasonable person” standard for offensive contact in battery. A plaintiff’s subjective, heightened sensitivity to a socially customary touching is insufficient to establish liability, even if the defendant intended the contact.

Case Facts & Court Holding

Key Facts & Case Background

Plaintiff Scott Gerber and Defendant Stephen Veltri were law professors with a strained relationship. Following an agitated confrontation between Gerber and a librarian, Veltri, the interim dean, encountered Gerber in a hallway. To get his attention and suggest they speak privately, Veltri placed his non-dominant hand on Gerber’s shoulder. Gerber described this as a “strong and tight” grab, while Veltri characterized it as a brief touch. Gerber immediately told Veltri to remove his hand, which Veltri did. Gerber later claimed the contact exacerbated a pre-existing degenerative rotator cuff tear and caused him mental anguish. However, he did not seek medical treatment for over a year, and an immediate examination by campus security revealed no visible signs of injury. Medical testimony established the contact did not cause the underlying tear. Psychological testimony indicated Gerber had pre-existing anxiety and difficulty coping with situations a reasonable person could handle. Veltri testified he did not intend to harm or offend Gerber, only to direct him to a nearby lounge to talk.

Court Holding & Legal Precedent
