Glencore Grain, a Netherlands corporation, obtained a $6.5 million arbitration award in London against Shivnath Rai, an Indian rice exporter. The underlying contracts, which stipulated English law and London arbitration, concerned the delivery of rice in India and had no connection to the United States. When Shivnath Rai failed to pay, Glencore filed an action in the U.S. District Court for the Northern District of California to confirm the award pursuant to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the “New York Convention”). To establish personal jurisdiction, Glencore presented evidence that Shivnath Rai had shipped rice into California fifteen times over a one-year period and used an independent, non-exclusive sales agent located in California.
