Author David Goodis wrote the novel “Dark Passage.” In 1945, he granted exclusive motion picture rights to Warner Brothers. He also granted Curtis Publishing Co. the right to serialize the novel in “The Saturday Evening Post” before its book publication. The novel was first published in eight installments in the magazine, which contained a single, general copyright notice in Curtis’s name in each issue. No separate copyright notice was placed in Goodis’s name. Years later, Warner Brothers’ rights were assigned to United Artists Television, Inc. (defendant), which produced the television series “The Fugitive.” Goodis’s estate (plaintiff) sued for copyright infringement. The defendants argued that because Curtis was merely a licensee of serialization rights and not the full proprietor of the work, its general copyright notice was insufficient to protect Goodis’s copyright. They contended this failure to comply with notice formalities under the doctrine of copyright indivisibility thrust the novel into the public domain upon its first publication in the magazine. The district court granted summary judgment for the defendants on this basis.
