Plaintiff Goss International Corp. (“Goss”) obtained a final judgment exceeding $31 million against Defendant Tokyo Kikai Seisakusho, Ltd. (“TKS”) for violations of the U.S. Antidumping Act of 1916. The judgment was affirmed through all levels of the U.S. federal judiciary. Subsequent to the initial verdict, Japan enacted a “Special Measures Law,” a clawback statute that authorized a Japanese party against whom a 1916 Act judgment was rendered to sue the U.S. plaintiff in Japan to recover the full amount of the judgment. After the U.S. Supreme Court denied certiorari, TKS notified Goss of its intent to file such a suit in Japan. Goss then moved for a preliminary foreign anti-suit injunction in the U.S. district court that had issued the original judgment, seeking to enjoin TKS from initiating the Japanese proceeding. Notably, when the U.S. Congress later repealed the 1916 Act, it deliberately made the repeal prospective, leaving pending actions like the instant case unaffected.
