The hospital staff, who are federal employees, failed to report the suspected abuse to the Illinois Department of Children and Family Services, a violation of the Illinois Abused and Neglected Child Reporting Act (ANCRA). The government conceded this statutory violation. Twenty-eight days later, Higgs was babysitting for another family and inflicted fatal injuries on their child, Christian Cuyler. Cuyler’s estate sued the United States under the Federal Tort Claims Act, which applies the tort law of the state where the act occurred—in this case, Illinois.
