John C. Burchard held a valid life insurance policy on his own life. After paying two premiums, he found himself in financial distress and in need of money for a surgical operation. He sold and assigned the policy to Dr. Grigsby for $100. As part of the agreement, Grigsby also assumed the obligation to pay all future premiums. Grigsby had no insurable interest in Burchard’s life, meaning he had no familial or financial relationship that would cause him to suffer a loss upon Burchard’s death. Upon Burchard’s death, both his estate administrators and Grigsby claimed the policy proceeds. The insurance company, acknowledging the validity of the policy itself, initiated an interpleader action by depositing the funds with the court to resolve the competing claims to the contractual benefit. The lower court limited Grigsby’s recovery to his out-of-pocket costs, voiding the remainder of the assignment on public policy grounds.
