Gucci America, Inc. sued Guess?, Inc., alleging that Guess engaged in a scheme to “Gucci-fy” its product line by infringing on several of Gucci’s famous trademarks and trade dress. The designs at issue included Gucci’s Green-Red-Green (GRG) Stripe, its Repeating GG Pattern, and its unregistered but famous Diamond Motif Trade Dress (the GG pattern in a brown/beige colorway). Gucci presented evidence that Guess’s licensee, MFF, intentionally copied the GRG stripe, with internal emails referencing “like the GUCCI.” Evidence also showed Guess intentionally copied the “upscale look” of Gucci’s Diamond Motif when creating its own “Quattro G” pattern, particularly in a similar brown/beige color scheme.
