Terry Hall died from adult respiratory distress syndrome approximately 14 hours after a successful abdominal surgery performed by Dr. Glyn Hilbun. The plaintiff, Hall’s husband, alleged negligent post-operative care. After the surgery, Dr. Hilbun did not see or inquire about Mrs. Hall’s condition after she left the recovery room, nor did he provide the nursing staff with specific instructions on when to contact him regarding significant changes in her vital signs. During the night, Mrs. Hall’s condition deteriorated and her vital signs fluctuated alarmingly, but the nursing staff did not notify Dr. Hilbun. At trial, the plaintiff sought to introduce testimony from two expert surgeons from Ohio to establish the standard of post-operative care. The trial court excluded their testimony under Mississippi’s then-existing “locality rule,” which required an expert to be familiar with the standard of care in the defendant’s specific community. Without this expert testimony to establish the standard of care and its breach, the plaintiff could not make a prima facie case of negligence, and the court granted a directed verdict for Dr. Hilbun.
