tl;dr: Owners sued builders for defective house construction. The court reversed awards for full rebuilding costs due to economic waste and for emotional distress, clarifying damage calculation principles in construction contracts.

Case Facts & Court Holding

Key Facts & Case Background

Carol and Melvin Northcutt (Plaintiffs) entered into an oral contract with Herb and Marge Hancock (Defendants) for the construction of an earth-sheltered concrete house for a disputed price, allegedly $65,000. Plaintiffs claimed Defendants agreed to complete all structural concrete work. Defendants disputed the price and asserted they performed extra work. Construction was delayed, with each party blaming the other. After the concrete pods were poured, Plaintiffs believed the work was defective and ordered Defendants off the job, refusing their offer to cure. Plaintiffs sued for breach of contract, alleging untimely and unprofessional performance and design changes, and also pled tort claims. They claimed the house leaked and was structurally unsafe, seeking repair costs and emotional distress damages. Defendants counterclaimed for amounts due. The jury awarded Plaintiffs substantial damages, including costs to demolish and rebuild the house and for emotional distress. Defendants appealed, challenging these damage awards.

Court Holding & Legal Precedent

Issue: Did the trial court err in instructing the jury that it could award the cost of demolishing and rebuilding a defectively constructed house, even if grossly wasteful, and in allowing damages for emotional distress arising from negligent performance of a construction contract?
