Harley-Davidson, Inc. (“Harley”) sued Ronald Grottanelli, owner of a motorcycle repair shop called “The Hog Farm,” for trademark infringement. Grottanelli had operated his shop since 1969. Evidence, including dictionary definitions and media articles from the 1960s and 1970s, showed that the word “hog” was a generic slang term for large motorcycles long before Harley began using it as a trademark in the 1980s. In fact, Harley had previously tried to disassociate itself from the term. In 1983, Harley formed the Harley Owners’ Group (“H.O.G.”) and later registered “HOG” as a trademark for motorcycles. Grottanelli also used a logo that mimicked Harley’s registered bar-and-shield design. Grottanelli’s version replaced “Harley-Davidson” with “American-Made” and added the phrase “UNAUTHORIZED DEALER.” He admitted his logo was intended to be similar to Harley’s. The district court enjoined Grottanelli’s use of the word “hog” (except in his business name) and his logo. Both parties appealed.
