Plaintiff Sherman Hawkins, an inmate, escaped from Montana State Prison, leaving personal property in his cell. Immediately following the escape, prison officials packed Hawkins’s property, which included a television, stereo, and word processor, into boxes labeled with his name and placed them in a prison storage room. Two days later, Hawkins was apprehended and returned to the prison. Over the next month, he made several requests for the return of his property. Prison officials allowed him to retrieve his legal papers but informed him that, per prison policy, all other property was considered abandoned due to his escape and would be destroyed or sold. Sometime thereafter, the prison disposed of Hawkins’s remaining property, which he valued at $2,290. Hawkins filed suit, alleging, inter alia, a violation of his property rights. The district court dismissed the complaint for failure to state a claim, concluding that Hawkins had abandoned his property as a matter of law by escaping.
