Halvard L. Heggstad executed a revocable living trust, naming himself as trustee and his son, Glen, as successor trustee. An attached schedule of assets (Schedule A) listed an undivided 34.78 percent interest in real property located at 100 Independence Drive. The trust instrument contained a declaration stating that Heggstad “has set aside and transfers to Halvard L. Heggstad in trust, as trustee, the property described in Schedule A.” While Heggstad formally transferred other real properties into the trust via separate deeds, he never executed or recorded a deed transferring his interest in the Independence Drive property to himself as trustee. After executing the trust, Heggstad married Nancy Rhodes Heggstad, who was not provided for in the trust or his will. As an omitted spouse, she was entitled to a share of his probate estate. Upon Heggstad’s death, a dispute arose as to whether the Independence Drive property was part of the trust or part of the probate estate available to the omitted spouse. The successor trustee petitioned the court for instructions, arguing the declaration in the trust document was sufficient to fund the trust with the property.
