Case Brief Summary & Legal Analysis
tl;dr: A man visiting his daughter at a hospital slipped on ice. The court abolished the distinction between invitees and licensees, holding that landowners owe a single duty of reasonable care to all lawful visitors, regardless of their purpose for being on the property.
Legal Significance: This case abrogated Nebraska’s common-law premises liability framework, replacing the status-based duties for invitees and licensees with a unitary standard of reasonable care for all lawful entrants. The trespasser classification remains distinct.

Case Facts & Court Holding
Key Facts & Case Background
Roger Heins visited the Webster County Hospital, where his daughter was the director of nursing. The purpose of his visit was disputed; Heins claimed it was partially to coordinate playing Santa Claus for the hospital’s Christmas celebration, while the hospital contended it was purely a social visit. Upon exiting the hospital’s main entrance, Heins slipped and fell on a patch of ice, sustaining an injury. The area had recently experienced a heavy snowfall. Heins filed a negligence action against the county-run hospital. The trial court, acting as the fact-finder, determined Heins was a social guest and therefore a licensee. Under the existing common-law framework, this meant the hospital only owed him a duty to refrain from willful or wanton negligence and to warn of known hidden dangers. Finding no breach of this limited duty, the trial court entered judgment for the hospital. Heins appealed, challenging the validity of the common-law entrant classifications.
