Plaintiff Henry Schein, Inc. (HSI), a distributor of healthcare products, alleged its former Field Sales Consultant, Defendant Jennifer Cook, misappropriated confidential and trade secret information before resigning to join a competitor, Patterson Dental. Cook had signed a Confidentiality and Non-Solicitation Agreement and a Letter Agreement requiring her to maintain the secrecy of HSI’s information. HSI alleged that days before resigning, Cook emailed confidential customer reports, generated by HSI’s proprietary software, from her work email to her personal email. These reports contained customer practice details, equipment inventory, price quotations, and prospective customer proposals. After resigning, Cook allegedly logged into HSI’s proprietary system to update customer data on her laptop, failed to return the laptop for two weeks, and accessed HSI’s system via an iPad app. HSI further claimed Cook attempted to delete emails and divert HSI customers. HSI sought a TRO to prevent Cook from using or disclosing the data, soliciting HSI customers, and requested expedited discovery, including forensic imaging of Cook’s personal devices.
