Donald P. Hicks obtained and recorded a judgment lien against Robert Grubbs’s real property, which was already encumbered by three superior deeds of trust. Subsequently, Grubbs sold the property to Kent and Jennifer Londre, financed by a loan from Chase Manhattan Mortgage Corporation (Chase). The purchase funds were used to pay off the first deed of trust held by Washington Mutual, which then released its lien. Compass Bank also released its second and third deeds of trust, despite receiving no proceeds. Neither the Londres nor Chase had actual knowledge of Hicks’s judgment lien, as their title insurance company failed to discover it. Hicks initiated a foreclosure action, claiming his lien had priority over the Londres’ interest and Chase’s new deed of trust.
