Tenants at the Gracious Estates Mobile Home Park formed a tenants’ association to address concerns about park conditions and rent increases. The relationship between the association and the park’s management, an agent of the owner Hillview Associates, deteriorated. A meeting on April 15, 1987, between tenant representatives and the park manager, Ms. Nitz, devolved into a shouting match. During the altercation, tenant Kimber Davenport verbally abused Nitz and ultimately struck her in the face. Shortly thereafter, Hillview served thirty-day termination notices on all tenants who had been present at the meeting, including the Davenports, Bloomquists, Swartzes, and Rays. After realizing the initial notices were procedurally defective, Hillview served new sixty-day notices. When the tenants refused to leave, Hillview filed a forcible entry and detainer action. The tenants asserted the affirmative defense of retaliatory eviction under the Iowa Mobile Home Parks Residential Landlord and Tenant Act, arguing the evictions were punishment for their protected unionizing activities.
