The U.S. Fish and Wildlife Service (FWS) proposed listing the Bruneau Hot Springs Snail as an endangered species under the Endangered Species Act (ESA) in 1985. The final rule listing the snail was issued in 1993, well beyond the ESA’s 12 or 18-month statutory deadlines. During the protracted rulemaking process, FWS commissioned several studies, including one by the U.S. Geological Survey (USGS) analyzing the hydrology of the snail’s habitat. This USGS report, which FWS relied upon significantly in its final rule to establish the cause of declining spring flows, was a provisional draft and was not made available to the public for comment before the final listing decision. The Idaho Farm Bureau Federation challenged the listing, arguing, inter alia, that FWS exceeded its authority by listing the snail after the statutory deadline and that FWS committed procedural violations under the Administrative Procedure Act (APA) by not allowing public comment on the USGS report. The district court set aside the listing. Conservation groups (ICL/CIHD), who had intervened, appealed.
