Case Brief Summary & Legal Analysis
tl;dr: The court vacated the Fish and Wildlife Service’s (FWS) rule listing a snail species as endangered due to procedural errors (failure to allow public comment on a key report), but held that statutory deadlines for listing are not jurisdictional bars to agency action.
Legal Significance: This case clarifies that statutory deadlines for agency rulemaking under the ESA are generally directory, not mandatory jurisdictional bars, and underscores the importance of public access to critical data relied upon by an agency during notice-and-comment rulemaking.

Case Facts & Court Holding
Key Facts & Case Background
The U.S. Fish and Wildlife Service (FWS) proposed listing the Bruneau Hot Springs Snail as an endangered species under the Endangered Species Act (ESA) in 1985. The final rule listing the snail was issued in 1993, well beyond the ESA’s 12 or 18-month statutory deadlines. During the protracted rulemaking process, FWS commissioned several studies, including one by the U.S. Geological Survey (USGS) analyzing the hydrology of the snail’s habitat. This USGS report, which FWS relied upon significantly in its final rule to establish the cause of declining spring flows, was a provisional draft and was not made available to the public for comment before the final listing decision. The Idaho Farm Bureau Federation challenged the listing, arguing, inter alia, that FWS exceeded its authority by listing the snail after the statutory deadline and that FWS committed procedural violations under the Administrative Procedure Act (APA) by not allowing public comment on the USGS report. The district court set aside the listing. Conservation groups (ICL/CIHD), who had intervened, appealed.
Court Holding & Legal Precedent
Issue: Did the Fish and Wildlife Service violate the Endangered Species Act by listing a species after the statutory time limits had passed, and did the agency violate the Administrative Procedure Act’s notice and comment requirements by relying on a significant report that was not made available for public review?
