Attorney Gwendolyn Laprath was the subject of multiple disciplinary complaints. In one matter (Johnson Complaint), Laprath, acting as representative payee for her disabled ex-husband’s Social Security benefits, paid herself unauthorized attorney fees. She then initiated a guardianship proceeding against his wishes, creating a conflict of interest by representing herself as a petitioner while also acting as his attorney and payee. In another matter (Kaupp Guardianship), she similarly petitioned to be appointed guardian for a client she deemed incompetent, against his wishes and after he had discharged her. In the Leighton Estates matter, she arranged for a client to borrow money, secured by estate property, to pay her a retainer, which she immediately spent on personal needs before earning the fees. Furthermore, Laprath failed to maintain a client trust account for years, commingled personal and client funds, kept deplorable records, and knowingly filed false trust account compliance certificates with the State Bar for nine consecutive years. At her disciplinary hearing, four sitting and former judges testified that Laprath was incompetent to practice law, citing her inability to analyze legal problems, her incomprehensible legal documents, and her failure to follow basic procedures.
