Martin Kohler’s will established a trust, with income payable to his daughter, Else Campbell, for life. Upon her death, the will directed the trust principal to be paid to her “issue per stirpes” at age twenty-five, or alternatively, “to such issue in such manner and in such sums” as Else directed in her will. Else’s will exercised this power, bequeathing a share to her son, Robert, contingent on him surviving her. Robert predeceased Else, leaving children (the appellants). Under the terms of Else’s will, Robert’s share lapsed and was redistributed, effectively disinheriting his children. The trustee distributed the trust assets accordingly without notifying Robert’s children. The children petitioned to reopen the estate’s adjudication, claiming they were wrongfully excluded because Else’s power of appointment was non-exclusive, which would have required her to appoint a share to all of her issue.
