Henry Weber, the testator, was ill and wished to execute a will. He remained in his car parked outside a bank while the bank president, Harold Holmes, drafted the instrument. For the execution ceremony, three bank employees stood inside the bank, looking out a closed window approximately eight to ten feet from Weber’s car. Weber signed the will on his car’s steering wheel, in view of the witnesses. Holmes then took the will inside the bank, where the witnesses signed it on a table situated below the window sill. From his car, Weber could see the witnesses’ upper bodies through the window but could not see the document or the physical act of signing itself. The only communication between Weber and the witnesses consisted of waving; there was no verbal exchange. The witnesses were familiar with Weber’s signature but could not read the contents of the document he signed. The trial court admitted the will to probate, and the guardian for Weber’s incompetent wife appealed.
