A Texas court issued an initial child custody determination in 1997, granting primary custody to the father, Robert Forlenza. The mother, Ann Forlenza, remained a resident of Texas. Immediately following the order, Robert and the two children moved out of state. Over the next five and a half years, they resided in Washington, Ohio, Virginia, and finally Colorado. During this period, the children visited their mother in Texas six times, with four of these visits being extended, month-long summer stays. Ann also traveled out of state to visit the children approximately fifteen times. Numerous relatives of both parents continued to reside in Texas and maintained relationships with the children. In 2001, Ann filed a motion in the original Texas court to modify the possession order. Robert challenged the court’s jurisdiction, arguing that after five years out of state, the children no longer had a significant connection to Texas and substantial evidence was not available there. The trial court denied Robert’s motion to dismiss, but the court of appeals granted mandamus relief, ordering dismissal. Ann then petitioned the Texas Supreme Court.
