Florence and Charles Button married in 1969, when she was 50 and he was 61. Both had been married before. At the time of marriage, Mrs. Button had minimal assets, while Mr. Button owned a business and substantial inherited property. They signed a prenuptial agreement without Mrs. Button receiving independent legal advice or full financial disclosure. At Mr. Button’s request, Mrs. Button stopped working outside the home and became a full-time homemaker. In 1974, after Mr. Button’s assets had appreciated significantly, they signed a postnuptial agreement drafted by his attorney. Mrs. Button again had no independent counsel and testified that no formal financial disclosures were made. The agreement stipulated that upon divorce, each party would keep their separate property, with Mrs. Button receiving only her personal items and half of any jointly titled property. After a 14-year marriage, the parties divorced. At the time of divorce, Mrs. Button was in poor health and residing in a nursing home. The agreement would have awarded her assets valued at $7,882, while Mr. Button would receive assets valued at $255,103. The trial court upheld the agreement’s property division.
