Colonel Vance Spath, a military judge, presided over Abd Al-Rahim Al-Nashiri’s capital military commission proceedings. In November 2015, Spath applied for an immigration judge position within the U.S. Department of Justice (DOJ), the same department involved in prosecuting Al-Nashiri. Spath highlighted his role in Al-Nashiri’s high-profile case in his job application. He did not disclose this application or subsequent employment discussions to Al-Nashiri or his defense counsel. During the period Spath was seeking employment with the DOJ, he made numerous rulings in Al-Nashiri’s case, including controversial decisions regarding the withdrawal of Al-Nashiri’s learned counsel. Spath received a job offer from the DOJ in March 2017 and eventually accepted the position. Al-Nashiri’s defense team discovered Spath’s job search through a FOIA request after Spath had abated proceedings and announced his impending retirement. Al-Nashiri petitioned for a writ of mandamus, arguing Spath’s conduct created a disqualifying appearance of partiality.
