Sally Olar (wife) and Terry Olar (husband) were married for twelve years. During the marriage, the wife worked full-time as a bookkeeper, providing the primary financial support while the husband was a full-time student, ultimately earning undergraduate, graduate, and doctoral degrees. The wife claimed there was an agreement that after the husband completed his education, he would support her while she pursued a college degree. The parties accumulated very little marital property. Shortly after the husband was poised to receive his Ph.D., the parties separated. At the time of dissolution, the wife was an unemployed, full-time student living with her parents and caring for the couple’s infant child. The husband had secured a job earning $35,000 per year. The trial court, following Graham v. Graham, held that the husband’s degree was not marital property. It also denied the wife maintenance, finding she was capable of supporting herself and thus failed to meet the statutory threshold of need. The court of appeals affirmed.
