Case Brief Summary & Legal Analysis

General Brief

tl;dr: The Iowa Supreme Court reversed an award of reimbursement alimony in a divorce, finding it inappropriate where the marriage was long, both parties were educated, and substantial assets were divided. Payments made were reclassified as rehabilitative alimony.

Legal Significance: This case clarifies that reimbursement alimony is typically reserved for short marriages where one spouse supports the other’s education, yielding few tangible assets, and is distinct from property division which already accounts for future earning capacity of marital assets.

Case Facts & Court Holding

Key Facts & Case Background

Ralane and Craig Probasco divorced after a marriage stipulated to have begun in November 1985. Both parties obtained business administration degrees early in the marriage, with neither contributing to the other’s education. Craig, with significant financial backing from his father and Ted Waitt, developed successful Perkins restaurant franchises. Ralane initially worked at home, assisted Craig with his early insurance business, and later worked for Wilson Trailer before becoming accounts payable coordinator at their first restaurant. She ceased working at the restaurant in 1998. The district court valued Craig’s 60% interest in CGP, Inc. (downtown Perkins) at $769,000 and his 50% interest in Probasco Properties (real estate for downtown Perkins) at $711,500. Ralane received a net property award of $801,082, including a $160,000 home purchased for her by Craig and a judgment of $580,250. Craig received net assets of $716,070. The district court also awarded Ralane reimbursement alimony of $60,000 per year for thirteen years, reasoning it was compensation for her contribution to Craig obtaining the franchise, likening it to a professional license.
