The supertanker Amoco Cadiz, owned by Amoco Transport Co. (Transport), a subsidiary of Standard Oil (Amoco), experienced a complete steering gear failure in a storm off the coast of Brittany, France, in 1978. The failure led to the ship running aground and causing one of history’s largest oil spills. Evidence showed that Amoco International Oil Company (AIOC), another Amoco subsidiary responsible for the vessel’s operation and maintenance, was aware of significant, long-standing defects in the steering system. These defects included scored hydraulic rams causing excessive oil leakage, contaminated hydraulic fluid, and other mechanical issues. Despite recommendations for repair and knowledge of these problems, AIOC, with Transport’s awareness, made a deliberate business decision to defer necessary drydocking and repairs to avoid losing income from the ship’s time charter with Shell. The crew was also found to be inadequately trained for steering failure emergencies. The Republic of France and other French parties sued Amoco and its subsidiaries for cleanup costs and other damages. Amoco filed for exoneration from or limitation of liability under the Limitation of Liability Act of 1851.
