Farrell Lines’ vessel, the S.S. AFRICAN NEPTUNE, was navigating out of Brunswick harbor at night. The transit required a critical 50-degree turn to pass through a bridge draw. On the bridge were two pilots, the ship’s master, a watch officer, and a helmsman. When a pilot ordered a 20-degree left turn, the helmsman correctly repeated the order but incorrectly executed a 20-degree right turn. The watch officer and pilots detected the error, but emergency maneuvers were insufficient to prevent the vessel from striking the bridge, resulting in ten deaths and ten injuries. Farrell Lines conceded it was not entitled to exoneration but petitioned to limit its liability pursuant to the Limitation of Liability Act, 46 U.S.C.A. § 183. The district court denied the petition, finding that Farrell had privity or knowledge of several unseaworthy conditions: insufficient personnel on the bridge, the watch officer’s dual duty of overseeing the helm and keeping the bell log book, and the improper positioning of the rudder angle indicator. Farrell Lines appealed.
