The appellant, acting as the administrator of an estate, conducted a sale of estate lands under a probate court decree. Although a third party was the initial high bidder, the administrator was ultimately substituted as the purchaser. He reported himself as the purchaser to the court, which confirmed the sale and conveyed title to him. Subsequently, the administrator resold the land for a significant profit. The complainants, who were the beneficiaries of the estate and minors at the time of the sale, filed a bill in equity many years later, after reaching the age of majority. They sought to impose a constructive trust on the profits the administrator realized from the resale, alleging a breach of his fiduciary duty. Two of the three beneficiaries filed their suit more than six years after attaining the age of majority.
