Josephine Jenkins executed a will in 1958, creating a testamentary trust for the benefit of her three sons as life income beneficiaries, with the remainder passing to their lineal descendants. The will specified that “[t]he determination of income and principal by the Trustees shall be in accordance with the income and principal statutes of the State of Florida.” At the time of the will’s execution and the testatrix’s death in 1960, the Florida Uniform Principal and Income Act (§ 690.06(1)) classified most corporate distributions, including capital gains from mutual funds, as income. Eight months after her death, the legislature amended the statute to classify capital gains distributions from mutual investment trusts as principal. The trustees subsequently invested in mutual funds and, following the amended statute, allocated over $100,000 in capital gains distributions to the trust’s principal. The income beneficiaries (the sons) challenged this allocation, arguing that the statute as it existed at their mother’s death should control, which would have classified the distributions as income payable to them.
