Melvin Jenkins was charged with manslaughter for fatally stabbing Bryan Cerezo. The altercation occurred in the common driveway between two trailers rented by Jenkins and his family. Cerezo, who was unknown to Jenkins, arrived at the property acting like a “wild man” and looking for Jenkins’s son. Jenkins came outside and repeatedly asked Cerezo to leave. Cerezo, who was larger than Jenkins, became furious, threatened to kill Jenkins and his family, and challenged Jenkins to a fight. Jenkins, who carried a knife as a work tool, discarded a hammer he was holding. Cerezo then punched Jenkins in the face, causing a bleeding cut and making his knees buckle. Jenkins drew his knife. As Cerezo charged at him a second time, Jenkins inflicted a single, fatal stab wound. The State’s own witnesses corroborated that Cerezo was the aggressor, threw the first punch, and that Jenkins had no opportunity to retreat before the second attack because Cerezo came at him “too fast.” Jenkins testified he only intended to “nick” Cerezo. The jury convicted him of manslaughter.
