tl;dr: A lessor of coin-operated laundry equipment sued for lost profits after the lessee breached. The court affirmed the award, recognizing the lessor as a “lost volume” lessee not required to mitigate damages by re-leasing the specific equipment.

Legal Significance: This case establishes the applicability of the “lost volume” seller/lessor doctrine to providers of services in Kansas, allowing recovery of lost profits without offset for subsequent transactions if capacity for both existed.

Case Facts & Court Holding

Key Facts & Case Background

Jetz Service Co. (Plaintiff) leased space from Salina Properties’ predecessor (Defendant) to install and operate coin-operated laundry equipment in an apartment complex for a six-year term. Jetz Service was entitled to a share of the gross receipts. With 16 months remaining on the lease, Salina Properties disconnected Jetz Service’s equipment and replaced it with its own. Jetz Service, which maintained a large inventory of approximately 1,500 used machines and constantly sought new locations, retrieved its equipment. Four of the five sets of machines were re-leased six months later, although Jetz Service had other suitable equipment available for this new lease. Jetz Service sued for lost profits for the remaining 16 months, arguing it was a “lost volume” lessee. The trial court agreed, awarding damages based on anticipated gross income less unpaid rent. Salina Properties appealed, contending Jetz Service failed to mitigate damages and did not prove lost profits.
