The upper portion consisted of three typewritten paragraphs containing testamentary dispositions but was not signed, dated, or attested by witnesses. At the bottom of the same page, the decedent wrote, entirely in his own handwriting, a provision disinheriting his brother with ten dollars and stating, “This will shall be complete unless hereafter altered, changed or rewritten.” This handwritten portion was then dated and signed by the decedent. Extrinsic evidence indicated the decedent had referred to the typewritten document as his will and later stated he had changed it by codicil. The lower courts denied probate, finding the instrument was not executed in accordance with statutory requirements for either a formal or a holographic will.
