Olivia McWilliams, an elderly widow with limited education but who was mentally competent and strong-willed, was befriended by a younger couple, the Frenches. After Mrs. French told McWilliams they would “take care of her for the rest of her life,” a confidential relationship formed. Shortly thereafter, McWilliams agreed to sell her home to the Frenches for $40,000. The terms were highly favorable to the Frenches: no down payment, payments deferred for two years, and an interest rate of only 1% per year, far below the prevailing market rate of 6-8%. McWilliams’s long-time attorney, Eugene Christol, advised her that the deal was financially unsound and attempted to dissuade her. Her nephew also tried to persuade her against it, reminding her of a much higher prior offer. McWilliams ignored this advice, stating her mind was made up. After the sale, McWilliams gave the Frenches joint access to her bank accounts, from which they received significant cash transfers. Following McWilliams’s death, the administrator of her estate sued to vacate the contract for deed and recover the cash transfers, alleging undue influence.
