Dafford O. Kennedy, the decedent, rented an apartment from Neona S. Kidd under an oral month-to-month tenancy. In June 1974, Kennedy died in the apartment from an apparent heart attack. His partially decomposed body was discovered a week later. Kidd alleged that putrid odors necessitated complete refurbishing of the apartment. Kidd presented a claim to Kennedy’s estate for rent and renovation expenses exceeding $4,000. The estate disallowed most of the claim. Kidd sued to enforce the claim. The estate (petitioner) demurred, arguing the estate was not liable for such losses. The trial court overruled the demurrer, and the petitioner sought interlocutory review. Respondent Kidd conceded no tort or waste occurred and did not rely on acts or omissions of the decedent during his lifetime. Her claim rested on the landlord-tenant relationship, asserting a common law duty to return the premises in good condition and public policy grounds.
