Peabody Western Coal Company (Peabody) operates a mine on lands where the Navajo Nation and the Hopi Tribe own subsurface mineral rights. The Office of Surface Mining (OSM) issued Peabody a permit with special conditions, including one to protect sacred sites. Peabody challenged this condition. Subsequently, Peabody, OSM, the Navajo Nation, and the Hopi Tribe entered into a settlement agreement that modified the condition. Maxine Kescoli, a member of the Navajo Nation, opposed the settlement, believing the modified condition offered insufficient protection for sacred burial sites in violation of the Surface Mining Control and Reclamation Act (SMCRA).
