Case Brief Summary & Legal Analysis

General Brief
3 min read

tl;dr: A defendant fled upon seeing police before they could initiate an investigatory stop. The court held that his flight, combined with a reliable informant’s detailed and corroborated tip, established probable cause for a warrantless arrest, rendering the subsequent search lawful.

Legal Significance: This case clarifies that a suspect’s unprovoked flight, when coupled with a detailed and corroborated tip from a reliable informant, can elevate what might have been reasonable suspicion into probable cause for a warrantless arrest, bypassing the need for an investigatory stop.

Case Facts & Court Holding

Key Facts & Case Background

A confidential informant (CI), known to police from prior interactions, reported that a man known as “Big Daddy” was trafficking methamphetamine. The CI provided a physical description of the suspect, his vehicle (a silver Lincoln Navigator with Texas plates), and his general location. In the presence of an officer, the CI arranged a controlled drug purchase from the suspect, designating a specific hotel parking lot known for drug activity as the meeting place. Police set up surveillance and observed a man matching the description, the appellant King, leave the specified residence in the described vehicle and drive to the hotel. King drove slowly through the lot, paused near a car of the same color as the CI’s, and then departed. Officers in marked patrol cars followed King without activating their lights or sirens. Upon pulling into a driveway and seeing the officers, King immediately exited his vehicle and fled on foot. Officers gave chase, apprehended him, and discovered nearly an ounce of methamphetamine during a search incident to arrest.
