Pauline Kirk, a registered nurse and charge nurse at Mercy Hospital, made a nursing diagnosis of toxic shock syndrome for a patient, Debbie Crain. Kirk became concerned that the treating physician was not providing appropriate care, specifically by failing to order antibiotics for the life-threatening infection. She repeatedly voiced her concerns to her supervisor, the Director of Nursing, who instructed her to “document, report the facts and stay out of it.” Kirk eventually escalated her concerns to the hospital’s Chief of Medical Staff, but the patient ultimately died. Shortly thereafter, the hospital terminated Kirk’s employment. The hospital’s service letter stated the cause for dismissal was making “untrue and detrimental” statements that “exhibited a lack of support for the hospital administration and medical staff.” Kirk filed suit, alleging she was wrongfully discharged for refusing to ignore improper patient care, in violation of public policy. The trial court granted summary judgment for the hospital, finding that Missouri did not recognize a public policy exception to the at-will employment doctrine.
