Attorney Robert Best represented multiple defendants in a federal civil rights lawsuit, including Officer Byron Klemme and the City of Columbia. Before the suit was filed, Best allegedly learned that Klemme was not involved in the incident but failed to disclose this to opposing counsel, purportedly to advance the interests of his other client, the City. As a result, Klemme was named as a defendant. In February 1987, upon discovering Best was negotiating a global settlement that included him, Klemme retained separate counsel. Klemme’s new counsel secured his dismissal from the lawsuit. In 1994, Klemme amended a separate malicious prosecution lawsuit to add Best as a defendant, alleging breach of fiduciary duty and constructive fraud. Klemme asserted that he did not discover the facts of Best’s pre-filing conduct and conflict of interest until depositions were taken in 1994. The trial court dismissed the claim against Best for failure to state a claim and as barred by the statute of limitations.
