In 1986, Monfort Supply Company sold a parcel of land to the Ranieris via a general warranty deed. The deed warranted that the title was “Clear, Free and Unincumbered” and that Monfort would “Warrant and will Defend the same against all claims of all persons whomsoever.” The deed did not mention or make an exception for a pre-existing 50-foot pipeline easement held by Mid-Valley Pipeline Co. However, the deed did refer to a plat map, which in turn contained an incorrect reference to the easement, citing the wrong deed book number. The original 1955 deed by which Monfort acquired the property had also noted the easement with the same incorrect reference. In 2001, the Ranieris sold the property to the Kohlbrands. After the Kohlbrands discovered the easement, they sued the Ranieris for fraudulent nondisclosure. The Ranieris then filed a third-party complaint against Monfort, asserting that Monfort’s general warranty obligated it to defend and indemnify them against the Kohlbrands’ claim. The trial court granted summary judgment for the Ranieris, and Monfort appealed.
