Kraft, Inc. launched an advertising campaign for its Kraft Singles cheese slices, known as the “Five Ounces of Milk” campaign. The ads stated that each slice was made from five ounces of milk and was high in calcium. The Federal Trade Commission (FTC) filed a complaint, alleging the ads made two false implied claims: (1) that a slice of Singles contains the same amount of calcium as five ounces of milk (the “milk equivalency” claim), and (2) that Singles contain more calcium than most imitation cheese slices (the “imitation superiority” claim). In reality, about 30% of the milk’s calcium is lost during processing, and most imitation slices are fortified to contain a similar amount of calcium as Singles.
